These Terms of Use (“Terms”) govern your use of the mobile games, applications, websites, and related services (collectively, the “Services”) provided by Factorial Studio Private Limited (“Factorial Studio”, “we”, “us”, or “our”).

By downloading, installing, accessing, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, do not install or use our games or websites.

These Terms apply to:

• Our mobile games and apps (“Apps”)

• Any related websites or pages we operate (the “Websites”)

• Any other online services we provide that link to these Terms
  
  

2. Acceptance of Terms

• Your access to or use of our Services signifies your acceptance of these Terms and all applicable laws and regulations.

• If you are using the Services on behalf of another person or entity, you confirm that you have the authority to accept these Terms on their behalf.
  
  

3. Changes to These Terms and to the Services

• We may update or modify these Terms from time to time.

• The most current version will always be available on our website or within our apps, with the “Last Updated” date changed accordingly.

• Where required by law or platform rules, we may display a notice inside the App or on the Website.

• By continuing to use the Services after changes become effective, you agree to be bound by the updated Terms.
  
  

We may also, at any time and without liability:

• Modify, suspend, or discontinue any App or any feature of an App;

• Introduce new features or remove existing ones;

• Restrict access to some or all users, where necessary (e.g., for legal, technical, or security reasons).
  
  

4. Eligibility & Age Requirements

• Our Apps are intended for users who meet the minimum age required by law in their country.

• In the EEA/UK, our Apps are not intended for users under 16, unless explicitly stated otherwise.

• In other regions, our Apps are generally not intended for users under 13, unless explicitly configured as child-directed.
  
  

If you are under the applicable age:

• You may use our Apps only under the supervision of a parent or legal guardian;

• The parent or guardian must read and agree to these Terms on your behalf.
  
  

5. License to Use Our Apps

Subject to your compliance with these Terms and applicable laws, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install our Apps on a device you own or control; and

• Use the Apps solely for your personal, non-commercial entertainment.
  
  

You agree that you will not:

• Copy, modify, distribute, sell, lease, or sublicense any part of the Services;

• Reverse engineer, decompile, or attempt to extract source code, except where such restriction is prohibited by law;

• Circumvent or attempt to bypass any security or technical protection in our Apps;

• Use our intellectual property (names, logos, designs, assets) without our prior written consent.
  
  

All rights not expressly granted to you are reserved by Factorial Studio and its licensors.

6. Virtual Items, In-App Purchases & Subscriptions

Some of our Apps may offer:

• Virtual items or currency (e.g., coins, gems, lives, boosts, cosmetics);

• One-time in-App purchases (e.g., “Remove Ads” or special packs);

• Subscriptions (e.g., weekly/monthly VIP or premium features).
  
  

6.1 Payments

• Purchases are processed by Google Play, Apple App Store, or other authorized platforms, not directly by us.

• We do not store your full payment card details.

• When you make a purchase, you also agree to the store’s own terms and conditions.
  
  

6.2 Subscriptions & Auto-Renewal

Where subscriptions are available:

• Subscriptions may automatically renew at the end of each billing period.

• The store may charge your account up to 24 hours before the current period ends.

• You can manage or cancel your subscription at any time via your Google Play or Apple App Store account settings.

• If you cancel, you will usually retain access until the end of the current billing period; no further renewal charges will apply after that.
  
  

6.3 Refunds

• All refunds are handled according to the Google Play / Apple App Store refund policies.

• We cannot directly issue or guarantee refunds for purchases made through the stores.
  
  

6.4 Virtual Items & Game Balancing

• Virtual items and currency have no real-world monetary value and cannot be redeemed for cash.

• They are licensed to you for use within the App, not sold to you.

• We may change, limit, adjust, or remove virtual items, prices, game balance, or availability at any time, with or without notice.

• We are not obligated to provide any refunds or compensation for unused or modified virtual items or currency.
  
  

7. Ads, Third-Party Content & Links

Our Services may include:

• Advertising (banner ads, interstitial ads, rewarded videos, etc.);

• Content, offers, or promotions provided by third parties;

• Links or redirects to third-party websites, stores, or services.
  
  

We do not control and are not responsible for:

• The content, accuracy, privacy practices, or availability of third-party websites or services;

• Any loss or damage that may arise from your use of third-party services.
  
  

Your interactions with third parties are solely between you and those third parties and are subject to their own terms and policies.

8. User Conduct

When using our Services, you agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose;

• Harass, threaten, or abuse other players or our staff;

• Upload or share content that is illegal, offensive, hateful, defamatory, or otherwise inappropriate;

• Use cheats, bots, hacks, scripts, or any unauthorized third-party tools to gain an advantage;

• Interfere with or disrupt the normal operation of the Services or servers;

• Attempt to gain unauthorized access to our systems or other users’ data.
  
  

We reserve the right to take appropriate action, including restricting features, temporarily suspending access, or permanently banning users who violate these Terms or any in-App rules.

9. Accounts (If Applicable)

Most of our games do not require a registered account. However, where account-based features exist (e.g., cloud save, social login):

• You are responsible for maintaining the confidentiality of your login details;

• You are responsible for all activity that occurs under your account;

• You should notify us promptly if you believe your account has been compromised.
  
  

We reserve the right to suspend or close accounts that we believe are being misused, shared in violation of policies, or involved in fraud or abuse.

10. Intellectual Property

All content in the Services, including but not limited to:

• Game graphics, characters, icons, UI, artwork, animations;

• Sound effects, music, and audio;

• Code, scripts, and software;

• Logos, names, and trademarks;
  
  

is owned by Factorial Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not use our intellectual property in any way except as allowed under these Terms without our prior written permission.

11. Availability, Maintenance & Force Majeure

• The Services are provided on an “as is” and “as available” basis. We do not guarantee that they will be available at all times or free from interruptions, delays, or errors.

• We may need to temporarily suspend or limit some or all Services for maintenance, updates, security fixes, or other technical reasons.
  
  

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to:

• Internet or network failures;

• Power outages;

• Hardware or software failures outside our control;

• Natural disasters, war, strikes, government actions, or legal restrictions.
  
  

Such events will not entitle you to any compensation.

12. Disclaimer of Warranties

To the maximum extent permitted by law:

• We do not represent or warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components;

• We do not guarantee that defects will be corrected or that the Services will work on every device or operating system version;

• We provide no warranty regarding the accuracy, completeness, or usefulness of any content in the Services.
  
  

Your use of the Services is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• Factorial Studio, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of business, or loss of opportunities, arising from your use or inability to use the Services.
  
  

• Our total aggregate liability for any claim relating to the Services shall, in any event, be limited to the amount you have paid to us (if any) in the three (3) months immediately preceding the event giving rise to the claim, or the minimum amount required by law if such limitation is not allowed.
  
  

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (e.g., liability for death or personal injury caused by our negligence, or fraud).

14. Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy, which explains in detail how we collect, use, and protect your data, as well as your rights.

By using our Services, you also acknowledge that you have read and understood our Privacy Policy.

15. Governing Law & Jurisdiction

These Terms and your relationship with Factorial Studio shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict-of-law principles.

You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Lahore, Pakistan, unless otherwise required by applicable law.
