Terms and Conditions – Purchase

1. Scope of These Terms

These Terms and Conditions (the “Purchase Terms”) govern the purchase of:

  • In-app products, items, or virtual currency (“In-App Purchases”), and
  • Recurring paid access to features or content (“Subscriptions”),

within the mobile games and applications published by Factorial Studio Private Limited (“Factorial Studio”, “we”, “us”, or “our”).

By making any In-App Purchase or Subscription in our Apps, you agree that:

  • You are entering into a legally binding contract, and
  • You have the legal capacity to do so, or you have permission from your parent or legal guardian to enter into this contract.

Please note that use of our Apps downloaded via the Apple App Store is also subject to the Apple Media Services Terms & Conditions / End User License Agreement, and Apps downloaded via Google Play are subject to Google Play’s terms and policies.

2. Where Purchases Are Processed (Apple / Google)

All In-App Purchases and Subscriptions in our Apps are:

  • Purchased from and billed by the Apple App Store or Google Play Store, not directly by Factorial Studio.

This means:

  • Your purchase is also subject to the terms and conditions of Apple or Google.
  • Factorial Studio does not have access to your full store account, payment card details, or complete transaction history.
  • If you want to verify what you bought, what type of subscription you have, or how you are billed:
    • Check your Apple ID / App Store account or
    • Your Google Play account and receipts.

On mobile devices, in-game purchases use the payment method you have on file in your Apple or Google account.

3. “No Ads” In-App Purchase

In many of our Apps, users may be able to buy a “No Ads” (or similarly named) In-App Purchase.

  • This feature is intended to stop or reduce ads that automatically interrupt gameplay (for example: full-screen interstitials during level transitions).

However:

  • The “No Ads” purchase does not disable optional “rewarded video” ads.
  • Rewarded ads are videos that you choose to watch in order to:
    • Double your rewards;
    • Gain extra coins, gems, energy, or lives;
    • Unlock skins, avatars, or other bonuses.

Because rewarded videos are fully optional and triggered by the user to gain a benefit, the “No Ads” purchase does not remove them.

4. Subscriptions & Free Trials

Some of our Apps may offer weekly, monthly, or other recurring Subscriptions (the “Subscription”) to access extra features or premium content (the “Subscribed Services”). In some cases, a free trial period may be available.

4.1 Free Trial Period (if offered)

  • A free trial (for example, 3 days) allows you to use the Subscribed Services without being charged during that period.
  • At the end of the free trial, the Subscription may automatically convert to a paid Subscription, and your Apple / Google account will be charged the Subscription price unless you cancel at least 24 hours before the trial ends.

Any unused portion of a free trial period may be forfeited when you purchase or continue a Subscription.

4.2 Auto-Renewal

  • Subscriptions are generally auto-renewing.
  • Your Apple or Google account may be charged for renewal within 24 hours before the current subscription period ends.
  • The Subscription will continue to renew automatically until you cancel it via your store account settings.

The price and billing frequency (e.g., weekly or monthly) will be displayed:

  • Inside the App, and/or
  • On the store’s purchase confirmation screen.

5. Managing & Cancelling Subscriptions (User Termination)

Subscriptions are managed exclusively by Apple App Store and Google Play Store.

In general:

  • Most Subscriptions automatically renew unless you cancel them.
  • If you cancel, you can normally continue using the Subscribed Services until the end of the current billing period.
  • If you cancel during a free trial, you may lose immediate access to the Subscribed Services, depending on the store’s policy.
  • If you signed up for a free or discounted trial and do not want to be charged, you must cancel at least 24 hours before the trial ends.

To manage or cancel your Subscription:

  • Apple (iOS):
    Go to Settings → [Your Name] → Subscriptions or open the App Store → Account → Subscriptions.
  • Google Play (Android):
    Open Google Play Store → Profile → Payments & Subscriptions → Subscriptions.

Factorial Studio cannot cancel Subscriptions or change billing on your behalf; only you can do this through your store account.

6. Termination by Factorial Studio

Except for the store’s automatic renewal process, Factorial Studio may cancel, suspend, or restrict your access to Subscribed Services if:

  • You fail to comply with our Terms of Use, Privacy Policy, or these Purchase Terms;
  • We suspect fraudulent, abusive, or unlawful activity related to your account or Subscription;
  • Continued provision of the Subscribed Services would violate applicable law, platform rules, or our internal policies.

Where technically and legally possible, we will try to notify you, but we are not obliged to provide any refund if access is terminated for the reasons above.

Automatic renewal itself remains managed by Apple / Google, and you remain responsible for cancelling any future renewals in your store account if you do not wish to continue your Subscription.

7. Refunds & Unused Currency / Items

Because all In-App Purchases and Subscriptions are processed by Apple or Google:

  • Any refund requests must be made directly to the respective store, and
  • Are subject to Apple’s or Google’s refund policies, not Factorial Studio’s internal policy.

Regarding virtual currency and in-game items:

  • Virtual currency and digital items have no real-world cash value and cannot be exchanged for money.
  • Factorial Studio is not required to provide a refund, compensation, or cash-out for:
    • Unused virtual currency;
    • Unused items or boosts;
    • Time remaining on a Subscription after you stop using the App;
    • Loss of progress due to device change, uninstall, or other non-mandatory reasons, unless required by law.

8. Legal Capacity & Parents / Guardians

By making any In-App Purchase or Subscription, you confirm that:

  • You are of legal age and capacity to enter into such a contract in your country, or
  • You have obtained permission from your parent or legal guardian.

Parents and guardians are responsible for:

  • Managing purchase settings and parental controls on the device and store account;
  • Monitoring and controlling their child’s in-App purchase behavior;
  • Ensuring that children do not make unauthorized purchases.
